Terms of Service

These terms govern your use of Streamwit — the dashboard, the wallet, every order you place and every channel you operate from it. Read them before placing your first order; placing one means you agree.

Section 01

Acceptance of these terms

By creating an account or placing an order on Streamwit you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

These terms form a contract between you and the operator of Streamwit. We may amend them; the “last updated” date at the top reflects the current version.

Section 02

What Streamwit is

Streamwit is a dashboard that lets streamers buy and operate promotional services for their own Twitch and Kick channels — including viewer presence, AI chat activity, clip and VOD views, and follower deliveries.

Delivery is executed by upstream fulfillment providers. We resell their inventory through a premium UX layer, with our own pricing, wallet, support, and bundles. We do not warrant inventory we do not control end-to-end.

Section 03

Eligibility and accounts

You must be at least 18 years old and legally able to enter into contracts. One account per person.

You are responsible for your credentials and for any activity under your account. Notify us immediately if you suspect unauthorized access.

Section 04

Wallet and top-ups

Streamwit runs on a USD prepaid wallet. Top up via card (processed through our gift-card bridge with FPSWare → OVGC) or crypto (OxaPay). Funds in your wallet do not expire.

Wallet balance is denominated in US dollars. Crypto deposits are converted at the provider rate at the moment of confirmation. We do not hold custody of any crypto; received funds are credited to your wallet as USD.

Crypto top-up bonus. Top-ups paid via OxaPay receive an additional 10% bonus credit, computed server-side and added to your wallet alongside the confirmed deposit. The bonus is part of your wallet balance, can be spent on any Streamwit service, but is not separately refundable. We may revoke bonus credit (and freeze affected balances) on fraud, chargeback or abuse — bonus deposits do not insulate funds from clawback under those conditions.

Wallet credit is not redeemable for cash. It can only be spent on Streamwit services. If your account is terminated for cause (fraud, abuse, chargebacks), any remaining balance may be forfeited as set out under Suspension.

Section 05

Orders, pricing and refunds

Prices shown in the dashboard are the final amount charged from your wallet at the moment of order placement, recalculated server-side from the live upstream catalog. Markup over our upstream cost varies by category and is reflected transparently in the displayed total. There are no hidden fees.

Failed orders. If our upstream provider rejects an order or fails to deliver, your wallet is automatically refunded for the full charged amount. In the rare case a refund cannot be processed atomically, the failed operation is held in a dead-letter queue and reconciled by support; reach out and we will resolve it.

Completed orders. Orders that delivered as configured are non-refundable. Promotional services produce engagement; they do not guarantee specific outcomes (followers earned, subscribers gained, partnership status). You accept this when placing the order.

Edits. You may edit running orders (count, geo, channel, mode) within the per-order limits exposed in the panel. Edits do not refund the original charge.

Section 06

Acceptable use

You agree to use Streamwit only for channels and content that:

  • You own or have explicit authorization to promote.
  • Comply with the Terms of Service of the destination platform (Twitch, Kick) and applicable law.
  • Do not promote hate, harassment, sexual content involving minors, or content prohibited by the destination platform.

You must not:

  • Use the service to target a third party’s channel without their consent.
  • Resell, rebrand, or expose Streamwit access through your own platform without a written partnership agreement.
  • Attempt to reverse engineer the service, probe the API beyond your own usage, or interfere with other users.
  • Use the service to commit fraud (including credit-card fraud and chargeback abuse).

Destination platform risk. Twitch, Kick and similar platforms expressly prohibit artificially inflating viewership, follower counts, chat activity or other engagement metrics. You are solely responsible for any action the destination platform takes against your channel — including suspension, partnership revocation, monetization loss or termination — arising from the use of fake-engagement, view-bot, or artificial-viewership services. Streamwit mitigates detection risk where possible but cannot guarantee immunity, and is not liable for platform-side enforcement against your channel.

Section 07

Third-party providers

Streamwit relies on the following third parties to deliver the service. Their terms apply to the portion they provide:

  • Upstream fulfillment providers — viewer, chat, view and follower delivery.
  • OxaPay — crypto payment processing.
  • OVGC Payments, accessed through our FPSWare gift-card bridge — card payment processing.
  • Supabase — authentication, database, and hosting of user data.
  • Hostinger — application hosting.

We do not control these providers and are not liable for outages, delivery delays or data handling on their side beyond the safeguards described in our privacy policy.

Section 08

Intellectual property

All branding, copy, design and code of the Streamwit application are owned by us. You may not copy, mirror, or rebrand the service.

Channel names, stream content, and any creator material remain yours; we never claim rights over your streams.

Section 09

Disclaimers

The service is provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all warranties — express, implied, statutory or otherwise — including fitness for a particular purpose and non-infringement.

We do not guarantee that promotional services will produce specific channel outcomes (affiliate status, partnership, monetization). The destination platforms (Twitch, Kick) may detect, throttle or remove promotional viewership at any time; we mitigate this with authorized accounts and safety patterns but cannot eliminate platform-side risk.

Section 10

Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the service — whether in contract, tort, statute or otherwise — is limited to the amount you paid to Streamwit in the six months immediately preceding the claim.

We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost subscribers, channel suspensions, or reputational harm.

Section 11

Suspension and termination

We may suspend or terminate your account, with or without notice, if:

  • You breach these terms.
  • We detect fraud, chargeback abuse, or payment reversals.
  • A destination platform notifies us of a violation involving your channel.
  • Continued service would expose us or other users to legal or safety risk.

On termination for cause, remaining wallet credit may be forfeited and active orders may be stopped without refund. You may close your account at any time from the Profile page; remaining wallet credit at the moment of self-closure is not refundable in cash but may be applied to your final orders.

Section 12

Governing law and disputes

These terms are governed by the laws of the operator’s home jurisdiction, without regard to its conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction, except where local consumer-protection law gives you mandatory rights you cannot waive.

If any provision is found unenforceable, the rest remains in effect.

Section 13

Changes to these terms

We may update these terms to reflect new features, providers or legal requirements. Material changes will be announced in-app or by email. Continued use of the service after a change constitutes acceptance.
